Global Candidate Privacy Policy

Productboard, Inc., and its affiliates (collectively “Productboard,” “we,” “us”, or “our”) values your trust and is committed to the responsible management, use and protection of your information. This Candidate Privacy Policy (“Policy”) informs you how we collect, use, secure and share your personal information in the context of your job application to Productboard. 

We may provide “just-in-time” disclosures or additional information about our data collection, use and sharing practices of specific services. These notices may supplement or clarify Productboard’s privacy practices or may provide you with additional choices about how Productboard processes your personal information.

Contents

In this Policy, “Personal Information” means information relating to an identified or identifiable natural person. An identifiable person is one who can be identified, directly or indirectly, including by reference to an identification number or to one or more factors specific to his/her physical, physiological, mental, economic, cultural or social identity. 

1. Information You Provide

Productboard collects Personal Information in connection with your application:

  • Personal contact details, such as your name (e.g., first and last name), home address and contact details (e.g., telephone number(s), and e-mail address);
  • Other information, such as date of birth and citizenship;
  • Emergency and reference contact details, such as their name (e.g., first and last name), home address, telephone number(s), email address and their relationship to you;
  • Employment-related information, such as work history and prior employer, description of current position, job title, company name, location, employment status, details of residency or work permit;
  • Education and career background, such as details contained in applications, LinkedIn URL (where provided), CV / résumé, cover letter (e.g., work experience, education history, qualifications, language(s) spoken and other relevant training, skills and certifications); 
  • Video and audio data, such as voicemail recordings, transcripts from phone or video calls (where permitted), photographs (e.g., where voluntarily included on CVs / résumés); and  
  • Any other information you elect to provide to us (e.g., demographic data, gender, employment preferences, willingness to relocate, current salary, desired salary, social media profiles, awards or professional memberships, military status, or disability information).

In certain cases, we will ask questions about race/ethnic origin and gender of our candidates for monitoring equal opportunity. We may also inquire about criminal records. We will do so only where so permitted by applicable law. 

Any information that you submit in connection with a job application must be true, complete and not misleading. Submitting inaccurate, incomplete or misleading information may lead to a rejection of your application during the application process or disciplinary action including immediate termination of employment. In addition, it is your responsibility to ensure that the information you submit does not infringe any third party’s rights.

If you provide us with the Personal Information of a reference contact or any other individual as part of your application, it is your responsibility to obtain consent from that individual prior to providing the information to us.

2. Information from Other Sources

To confirm the information in your application, or to support your application, and as permitted by applicable law, Productboard may obtain information about you from other sources, including:

  • The Careers section of our website (located at: https://www.productboard.com/careers/ (“Careers Site”));
  • Third-party recruitment platforms (including, but not limited to, LinkedIn and BuiltIn);
  • Recruiters and referrals;
  • Your references;
  • Prior employers;
  • Educational institutions you attended;
  • A background check report in connection with your application;
  • Publicly available information (including, but not limited to, platforms such as GitHub, Stackoverflow, Discord and Meetup); 
  • Applicant tracking systems, fraud detection software and recruitment analytics providers such as Gem ATS (provided by Gem Software, Inc.) and Metaview (provided by Metaview, Inc.); and
  • Offline.

3. Use of Personal Information

We collect, use and disclose Personal Information for the purposes set out below using the following legal bases under the General Data Protection Regulation, as applicable in the EU and retained in the UK. For example, using Personal Information:

To verify your application, assess your capabilities and qualifications for a position, including evaluating your suitability for the position(s) you are applying for.

We will engage in these activities based on our legitimate interests in verifying and evaluating applicants and managing recruitment logistics, where necessary to take steps prior to entering a contract with you or for other purposes as permitted or required by law.

To conduct reference checks.

We will engage in these activities to comply with a legal obligation or based on our legitimate interests in providing candidates with information, updates and communications regarding their applications, where necessary to take steps prior to enter into a contract with you or for other purposes as permitted or required by law.

To respond to your inquiries and communicate with you about your application, including, subject to our discretion, to make an offer to enter into an employment contract or other contract for services and to send you information regarding the Careers Site and changes to Productboard’s terms and policies.

We will engage in these activities to comply with a legal obligation or based on our legitimate interests in providing candidates with information, updates and communications regarding their applications, where necessary to take steps prior to enter into a contract with you or for other purposes as permitted or required by law.


To comply with or monitor compliance with any applicable law or regulation, internal policies and other requirements such as record-keeping, equal employment opportunity and equality laws, work permit and immigration regulations, reporting obligations, and the exercise or defense of legal claims in the context of litigation or a regulatory investigation.


We will engage in these activities with your explicit consent, where required, to comply with a legal obligation (such as equal employment opportunity and/or workforce reporting requirements) or based on our legitimate interests in complying with local hiring practices, promoting equal employment opportunity in accordance with applicable law and protecting our business.


To conduct background checks if we offer you a position.


We will engage in these activities to comply with a legal obligation, or based on our legitimate interests. 


To respond to legal process or other requests from public and government authorities, including public and government authorities outside your country or region of residence and to meet national security or law enforcement requirements.


We will engage in these activities to comply with legal obligations or based on our legitimate interests in ensuring regulatory compliance and protecting our legal rights, or for other purposes as permitted or required by law.


To preserve Productboard’s other legitimate interests, for example, for Productboard’s administrative purposes, aggregate management reporting, internal training, and as generally required to conduct our business within Productboard and its affiliates.


We will engage in these activities based on our legitimate interests in managing the recruitment process, assessing applicants, maintaining efficient hiring operations, or for other purposes as permitted or required by law.


In connection with a sale or business transaction.


We will engage in this activity based on our legitimate interest in disclosing or transferring your Personal Information to a third party in the context of any reorganization, financing transaction, merger, sale, joint venture, partnership, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).


To enforce Productboard’s terms and conditions and to protect Productboard’s rights, privacy, safety or property, and/or that of our affiliates, you or others.


We will engage in these activities to comply with a legal obligation or based on our legitimate interests in protecting our business, rights, and interests, as well as those of our affiliates and candidates.



The information about you will be added to Productboard’s international candidate database and can be retained and used to consider you for opportunities at Productboard and its subsidiaries other than the one(s) for which you apply. If you do not wish us to do this, please contact us at the address in the “Contact Information” section (see Section 16) below.

If you are recruited by Productboard, Personal Information collected in connection with your application can be incorporated into Productboard’s human resources system and used to manage the recruitment and onboarding process; any such information can become part of your employee file and used for other employment-related purposes, consistent with applicable law.

Applying for a role at Productboard is voluntary. However, if you do not provide the required information to support your application, Productboard may be unable to consider your employment application. To the extent that you decide to provide or make available Personal Information that is not required for the purposes as described above, your decision to provide such Personal Information is voluntary.

Any Personal Information sent to us may be used by Productboard, Inc. and its agents and service providers for the purposes described above. If we intend to use your Personal Information for a purpose that is materially different from these purposes, or if we intend to disclose it to a third party (a non-agent or a non-service provider) not previously identified, we will notify you and offer you the opportunity to opt out of such uses and/or disclosures where non-sensitive information is involved or opt-in to such uses and/or disclosures where sensitive information is involved.

4. Use of Automated Processing and Artificial Intelligence

Subject to applicable law, Productboard uses applicant tracking systems, fraud detection software and recruitment analytics providers such as Gem ATS (provided by Gem Software, Inc.) and Metaview (provided by Metaview, Inc.) to support our recruitment process. These tools process Personal Information on our behalf as data processors, in accordance with our documented instructions. These platforms may include AI-powered functionality that assists our recruiters by automating the sorting, filtering or summarizing of candidate information. For example, AI may be used to match candidate profiles against job requirements or to transcribe and summarize interviews.

Before any interview (whether via video or telephone) is recorded, you will be asked whether you consent to the use of interview recording and transcription tools. If you do not consent, your interview will proceed without the use of such tools. Your decision will not affect the outcome of your application. Where you do provide consent, audio and/or video recordings of your interview, transcriptions, and AI-generated notes may be collected.

All hiring decisions are made by the relevant internal team at Productboard. AI and automated processing tools are used solely to assist our recruitment team; these tools do not make hiring decisions on Productboard’s behalf. You will not be subject to decisions that have a legal or other significant adverse effect based solely on automated processing.

5. Disclosure of Personal Information

We disclose Personal Information for the purposes described above in this Policy to:

  • Affiliates. Productboard shares Personal Information with its affiliates (Productboard Canada, Inc. (Canada), Productboard UK Limited (United Kingdom), Productboard Ireland Limited (Ireland), Productboard Czechia s.r.o (Czech Republic), StatisMeter s.r.o (Czech Republic)) when an affiliate is involved in evaluating candidates for a given position. Productboard, Inc. will remain responsible for Personal Information that is shared with affiliates. 
  • Personnel. We will limit access to Personal Information to personnel with a business need to know the information for the purposes described in this Policy, including personnel in the recruiting, human resources and information technology departments, and in the department responsible for the position for which you are applying. 
  • Agents and Service Providers. Productboard shares Personal Information with our third-party service providers to facilitate services they provide to us, including website hosting, data analysis, payment processing, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, auditing and other services including operating the Careers Site, applicant-tracking, background check processing, interview recording and transcription and AI-assisted recruitment tools as described in Section 4 above. These third parties may have access to Personal Information only as needed to perform their functions and are restricted from using the Personal Information for purposes other than providing services for us or to us. Productboard, Inc. requires that its service providers that have access to Personal Information received from the EEA, the UK and Switzerland provide the same level of protection as required by the DPF Principles (defined below in Section 7). We are responsible for ensuring that our service providers process the Personal Information in a manner consistent with our obligations under the DPF Principles.

6. Transfer of Personal Information

Disclosing your Personal Information as set out above in Section 5 may include transferring your Personal Information to countries other than the location of the role to which you are applying, including the United States (“US”) or any other country in which we or our service providers have operations, for example: Canada, the Czech Republic, Hungary, Ireland, Poland, Slovakia, Spain, other EU member states or the United Kingdom.

If you are located in the European Economic Area (the “EEA”) or United Kingdom (the “UK”), this may include countries outside of the EEA or UK. Some of these countries are recognized by the European Commission as providing an adequate level of protection according to EEA standards. The full list of these countries is available:

As for transfers of Personal Information from the EEA or UK to countries that are not considered adequate, Productboard has put in place appropriate measures, such as data transfer agreements, Standard Contractual Clauses, and/or the EU-US Data Privacy Framework (for transfers to the US). 7. EU-US Data Privacy Framework Disclosures

Productboard, Inc. has certified to the EU-US Data Privacy Framework, the UK Extension to the EU-US Data Privacy Framework, and the Swiss-US Data Privacy Framework (collectively “DPF”) with regard to the processing of Personal Information received from the EEA, the UK, Gibraltar, and Switzerland, and we are committed to adhering to the DPF Principles for Personal Information covered by this Policy. More information about the DPF, including the list of certified organizations, can be found at https://www.dataprivacyframework.gov/.

DPF Enforcement and Dispute Resolution:

If you have any questions or concerns, please write to us at the address listed below (see Section 16). We will investigate and attempt to resolve such complaints and disputes in accordance with the DPF Principles.

In compliance with the EU-US DPF and the UK Extension to the EU-US DPF, Productboard, Inc. commits to cooperate and comply with the advice of the panel established by the EU data protection authorities (“DPAs”) and the UK Information Commissioner’s Office (“ICO”) with regard to unresolved complaints concerning our handling of human resources data received in reliance on the EU-US DPF and the UK Extension to the EU-US DPF in the context of the employment relationship. 

As further explained in the DPF Program Principles, a binding arbitration option link will also be made available to you in order to address residual complaints not resolved by any other means. Productboard, Inc. is subject to the investigatory and enforcement powers of the US Federal Trade Commission (“FTC”).

Disclosures Required By Law:

We may need to disclose Personal Information in response to lawful requests by public authorities for law enforcement or national security reasons or when such action is necessary to comply with a judicial proceeding or court order, or when otherwise required by law.

8. Data Security

We use reasonable physical, electronic, and administrative safeguards to protect your Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the nature of the Personal Information and the risks involved in the processing of that information.

9. Data Integrity and Purpose Limitation

We limit the collection and use of Personal Information to the information that is relevant for the purposes of processing and will not process Personal Information in a way that is incompatible with the purposes for which the information has been collected or subsequently authorized by you. We take reasonable steps to ensure the Personal Information is reliable for its intended use, accurate, complete, and current to the extent necessary for the purposes for which we use the Personal Information.

10. Data Retention

Productboard will retain Personal Information for the period necessary to fulfil the purposes outlined in this Policy unless a longer retention period is required or permitted by law. 

The criteria used to determine our retention periods are:

  • The duration of the job application process;
  • As long as we have an ongoing relationship with you;
  • As required by a legal obligation to which we are subject; and
  • As advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation or regulatory investigations). 

Once the retention period has ended, we will either delete or anonymize Personal Information, or, if this is not possible (for example, because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

11. Individual Rights, Requests and Complaints

If you reside in certain territories (such as California, the EEA, Switzerland, the UK, Japan or Brazil), you may have the right to exercise certain privacy rights available to you under applicable law. If any of the rights listed below are not provided under law for your jurisdiction, we have the absolute discretion in providing you with those rights.

Your Personal Information rights are not absolute and your rights or requests may be subject to exceptions under applicable law. Depending upon your jurisdiction and the applicable law, you might have the rights to request the following: 

  • Right not to provide consent or to withdraw consent: We may seek to rely on your consent in order to process certain Personal Information. Where we do so, you have the right not to provide your consent or to withdraw your consent at any time. This does not affect the lawfulness of the processing based on consent before its withdrawal.
  • Right of access and/or portability: You may have the right to access the Personal Information that we hold about you and, in some limited circumstances, have that data provided to you so that you can provide or port that data to another provider.
  • Right of erasure/deletion: In certain circumstances, you may have the right to the erasure of Personal Information that we hold about you (for example if it is no longer necessary for the purposes for which it was originally collected).
  • Right to object to, issue a complaint to us about, or restrict processing: You may have the right to request that we stop processing your Personal Information or restrict processing in certain circumstances and to issue a complaint to us about our processing.
  • Right to rectification/correction: You may have the right to require us to correct any inaccurate or incomplete Personal Information.
  • Right to lodge a complaint with your local data protection authority: You may have the right to lodge a complaint with your national data protection authority or equivalent regulatory body, for example, a list of EEA data protection authorities is available here: https://www.edpb.europa.eu/about-edpb/about-edpb/members_en. If the UK law applies, you may lodge a complaint with the Information Commissioner’s Office (https://ico.org.uk/). 


Your rights and our responses will vary based on your state or country of residency.

To assert your privacy rights, please email privacy@productboard.com with the subject line, “Privacy Rights Request.” Please note that to protect your privacy and security, we must be able to verify your identity before we can process your request to exercise any of the privacy rights that you may be entitled to under the applicable law. We may conduct the verification process by email or phone, and we may ask you to provide information to verify you such as your name, contact information, and any additional relevant information based on your relationship with us. 

You may also use an authorized agent to submit a request to opt out on your behalf if you provide the authorized agent signed written permission to do so. If you would like to request to access, correct, update, suppress, restrict or delete Personal Information, object to or issue a complaint about our processing of your Personal Information, or if you would like to request to receive an electronic copy of your Personal Information for purposes of transmitting it to another company (to the extent this right to data portability is provided to you by applicable law), you may contact us by sending a written request to privacy@productboard.com.

12. Law Applicable to Job Application

The Careers Site allows you to apply for jobs worldwide, as a benefit of Productboard’s centralized global recruitment function. This Careers Site is operated from the United States. Accordingly, any Personal Information you submit to the Careers Site will be collected in the United States and may also be subject to US laws. 

If we share your Personal Information with an affiliate located in another country in its capacity as a potential employer, the affiliate will handle your Personal Information in accordance with this Policy. Any hiring or other employment-related decisions will be made by the hiring affiliate in accordance with the laws of the country where the job will be located.

  1. Minors

The Careers Site is not intended for minors under the age of 18. 

  1. Current Personnel of Productboard

If you currently work for Productboard or one of our affiliates, you may be eligible to apply for a different position within Productboard through the Careers Site. If you accept such a position, your benefits programs and human resources policies may change. Please consult with the HR manager for the new position concerning application eligibility, benefit programs and HR policies applicable to that position.

The Careers Site is not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation.

13. Links to Third-Party Websites

This Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any website or service to which the Careers Site links. The inclusion of a link on the Careers Site does not imply endorsement of the linked site or service by us or our affiliates.

15. Privacy Policy Changes

This Policy may be changed or updated from time to time. You can determine when this Policy was last revised by referring to the “Last Updated” legend at the top of this page. Any changes to our Policy will become effective upon our posting of the revised Policy on the Site.

This Addendum supplements the above Policy and provides additional information for California residents pursuant to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”).

We may also disclose the above categories of Personal Information to a third party in the context of any reorganization, financing transaction, merger, sale, joint venture, partnership, assignment, transfer, or other disposition of all or any portion of our business, assets, or stock (including in connection with any bankruptcy or similar proceedings).

We do not sell Personal Information (including Sensitive Personal Information), and we do not “share” Personal Information (including Sensitive Personal Information) for purposes of cross-context behavioral advertising, as defined under the CCPA. We have not engaged in such activities in the 12 months preceding the date this Policy was last updated. Without limiting the foregoing, we do not sell or share Personal Information (including Sensitive Personal Information) of minors under 16 years of age.

Purposes for the Collection, Use, and Disclosure of Sensitive Personal Information 

We collect, use, and disclose Sensitive Personal Information for purposes of: short-term transient use; resisting and responding to fraud or illegal activities; employment screening and background checks; as necessary to comply with legal obligations, including accommodation and reporting requirements under state and federal law; diversity analytics; to assess whether a work permit or visa will be necessary for the role; and other collection and processing that is not for the purpose of inferring characteristics about an individual. We do not use or disclose Sensitive Personal Information for any purpose not expressly permitted by the CCPA.

Individual Rights and Requests

You may, subject to applicable law, make the following requests:

  1. You may request that we disclose to you the following information: 
  2. The categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information;
  3. The specific pieces of your Personal Information;
  4. The business or commercial purpose for collecting Personal Information about you;
  5. The categories of Personal Information about you that we disclosed for a business purpose and the categories of service providers or contractors to whom we disclosed such Personal Information; and 
  6. The categories of third parties to whom we disclosed Personal Information about you (if applicable).
  7. You may request to correct inaccuracies in your Personal Information.
  8. You may request that we delete your Personal Information that we have collected from you.

You have the right not to be unlawfully retaliated against for exercising your privacy rights under the CCPA. 

To make a privacy request, please contact us at privacy@productboard.com. We will verify and respond to your request consistent with applicable law, taking into account the type and sensitivity of the Personal Information subject to the request.  

We may need to request additional information, such as information specific to your CV, in order to verify your identity and protect against fraudulent requests. If you maintain a password-protected account with us, we may verify your identity through our existing authentication practices for your account and require you to re-authenticate yourself before disclosing or deleting your Personal Information. If you make a request to delete, we may ask you to confirm your request before we delete your Personal Information.

Authorized Agents

If an agent would like to make a request on your behalf as permitted by applicable law, the agent may use the submission methods noted in the section entitled “Individual Rights and Requests.” As part of our verification process, we may request that the agent provide, as applicable, proof concerning their status as an authorized agent. In addition, we may require that you verify your identity as described in the section entitled “Individual Rights and Requests” or confirm that you provided the agent permission to submit the request.
